1. Introduction

Welcome to WebHostNet.in ("Website"), a web hosting service operated by Web Seasoning, a sole proprietorship registered in India (GSTIN: 08BFPPS2936J1ZR), with its principal place of business in Jaipur, Rajasthan, India ("Company", "we", "us", or "our").

By accessing or using our services, you ("Customer", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Definitions

  • "Services" means web hosting, VPS hosting, domain registration, email hosting, and any other services provided by WebHostNet.in
  • "Account" means the customer account created to access our Services
  • "Content" means any data, files, websites, applications, or materials uploaded, stored, or transmitted through our Services
  • "Billing Cycle" means the recurring period for which you are billed (monthly, yearly, or biennial)

3. Account Registration

3.1. To use our Services, you must create an account by providing accurate, current, and complete information.

3.2. You must be at least 18 years of age to create an account. If you are under 18, you may use the Services only with the involvement and consent of a parent or guardian.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Services and Service Level Agreement

4.1. Uptime Guarantee: We strive to maintain 99.9% uptime for all shared hosting and VPS services. This excludes scheduled maintenance, which will be notified at least 24 hours in advance when possible.

4.2. Shared Hosting: Resources are shared among multiple customers. Excessive resource usage that affects other customers may result in account suspension or upgrade requirements.

4.3. VPS Hosting: Dedicated resources as per your selected plan. Root access is provided; you are responsible for server security and software updates.

4.4. Backups: Daily backups are provided for eligible plans. However, you are ultimately responsible for maintaining your own backups. We do not guarantee backup availability or integrity.

5. Payment Terms

5.1. Pricing: All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes (GST at 18%) unless otherwise stated.

5.2. Payment Methods: We accept payments via PayU (UPI, Credit/Debit Cards, Net Banking), PayPal, and Bank Transfer.

5.3. Billing Cycle: Services are billed in advance for the selected billing period (monthly, yearly, or biennial).

5.4. Auto-Renewal: Services will automatically renew at the end of each billing cycle unless cancelled at least 7 days before the renewal date.

5.5. Late Payments: Accounts with overdue payments may be suspended after a 7-day grace period. If payment is not received within 30 days, the account may be terminated and data deleted.

5.6. GST Invoice: A GST-compliant invoice will be issued for all payments. Our GSTIN is 08BFPPS2936J1ZR.

6. Acceptable Use Policy

6.1. You agree to use our Services only for lawful purposes and in accordance with our Acceptable Use Policy (AUP).

6.2. The following activities are strictly prohibited:

  • Hosting illegal content under Indian law or international law
  • Distributing malware, viruses, or malicious code
  • Sending unsolicited emails (spam)
  • Hosting phishing websites or engaging in fraud
  • Infringing intellectual property rights
  • Hosting adult/pornographic content (unless on dedicated servers with prior approval)
  • Cryptocurrency mining on shared hosting
  • Running IRC servers, bots, or proxies on shared hosting

6.3. We reserve the right to suspend or terminate accounts that violate our AUP without prior notice.

7. Resource Usage (Shared Hosting)

7.1. Shared hosting accounts are subject to fair usage policies:

7.2. Accounts exceeding these limits may be asked to optimize or upgrade to a higher plan.

8. Data Protection and Privacy

8.1. We collect and process personal data in accordance with our Privacy Policy and applicable Indian data protection laws.

8.2. You retain ownership of all Content you upload to our Services.

8.3. You grant us a limited license to store, backup, and transmit your Content solely for the purpose of providing the Services.

9. Limitation of Liability

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

9.2. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

10. Account Termination

10.1. By You: You may cancel your account at any time through the customer portal or by contacting support.

10.2. By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay invoices, or engage in fraudulent activity.

10.3. Data Retention: Upon termination, your data will be retained for 30 days before permanent deletion, unless required otherwise by law.

11. Dispute Resolution

11.1. Governing Law: These Terms shall be governed by the laws of India.

11.2. Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.
